GENERAL TERMS AND CONDITIONS OF SALE

ARTICLE 1 – Scope of application of the general conditions

The present General Terms and Conditions of Sale (GTCS) apply by right to any person participating in the Vinea Lucens event. The sale is deemed to have been concluded on the date of acceptance of the supply of the service by Orpheo. Prior to this date, the present conditions are made available to the customers as referred to in article L113-3 of the French Consumer Code.
Any sale implies unconditional acceptance of:
– these general terms and conditions of sale which prevail over all other conditions ;
– the privacy policy of the Vinea Lucens website which can be consulted in the heading GTCU – Privacy policy.

ARTICLE 2 – Services

Orpheo, the Centre des Monuments Nationaux and Les Allumeurs de Rêves provide visitors with a 500-metre tour, secured and lit, located in the medieval city of Carcassonne, open to all, with cobbled passages and crenellated ramparts. Visitors must stay on the marked and secured pathway. Booking entitles the visitor to a tour of the Vinea Lucens trail, which consists of 17 steps, and to the provision of tour devices (audioguide and open headphones).

ARTICLE 3 – Access to the tour, sale and booking

Access to the Vinea Lucens tour is possible during the periods, days and times set out in the booking calendar.
Tickets for the event are sold:
– Either on the Internet at www.vinealucens.com/en, under the heading “Booking” (preferred procedure); ;
– Or directly at the Narbonnaise Gate, at the entrance to the medieval city, on the day of the event; the sale is then considered firm and definitive.

ARTICLE 4 – Rates

Except in the case of special conditions specific to the sale, the rates are those mentioned on the day of the booking. The rates are firm and definitive on this date. They are expressed in legal currency and stipulate all taxes included. The prices displayed are inclusive of VAT in euros and take into account the VAT applicable on the day of the order; any change in the rate may be passed on to the price of the products or services.

ARTICLE 5 – Payment methods

Payment for tickets to the Vinea Lucens event can be made by credit card (preferred method of payment), by cheque upon presentation of an identity card, by cash, by bank transfer, as follows:
– On the online ticketing service (only by credit card);
– Cash on the day of entry at the Porte Narbonnaise (reception);
No entry will be authorised without full payment on the day of entry.
An invoice will be given to customers on request. In the event of cancellation of the reservation by the client, the deposit paid will not be returned. They will be acquired as damages.

ARTICLE 6 – Online ticketing, e-tickets

When purchasing tickets, the buyer must specify:
– Name, telephone number and e-mail address;
– The service(s) selected (in this case, access to the Vinea Lucens night-tour and the desired time slot);
– The date of their desired execution;
– The number and age of the beneficiaries (in the form of a choice of rates)
The tickets ordered online are published in the form of e-tickets, the e-tickets must be downloaded by the Buyer from his/her mailbox. It is not compulsory to print out tickets, their digital version is accepted.
E-tickets purchased via the online ticketing service are valid for the date indicated on the ticket; they are not refundable but may be exchanged subject to availability and in the event of cancellation by the organiser (bad weather or strong winds).
Validity and use of tickets: In order to enter the Vinea Lucens tour, the Purchaser or Beneficiary of the ticket must present it at the reception desk. Any ticket modified or damaged by the Purchaser will be refused if the major information is illegible. It is not necessary to print out the e-ticket, as it can be read and/or scanned directly on the smartphone. The ticket must be in the name of the person who made the reservation. The other beneficiaries can be identified by the person who made the payment on the online platform, i.e. the Buyer. It is therefore not necessary to enter the details of all the beneficiaries, only the Buyer is obliged to do so.
Please note that legislation excludes leisure ticket purchases from the withdrawal period.

ARTICLE 7 – Closure of the visit, cancellation of the event, capacity

The organisers reserve the right to close the Vinea Lucens visit, or certain parts of it, for reasons of safety, force majeure or fortuitous event, which can in no way engage the responsibility of the organisers. The organisers will follow the weather forecasts of the Météo France agency and will proceed to the cancellation of the course in case of an orange alert. In the event of unforeseeable bad weather, the organisers reserve the right to close the Vinea Lucens tour in order to preserve the safety of people. In the event of cancellation, the organisers must inform the clients as soon as possible, by email and/or SMS and indicate the procedure to follow to postpone their visit.

In this case, and insofar as the Customer can justify his inability to return at a later date, the face value of the Ticket paid by the Customer, excluding commission, shall be reimbursed by the organisers to the exclusion of any other compensation or indemnity whatsoever. Under these conditions, the refund will be made upon written request from the interested party specifying the date on which he/she was unable to visit, accompanied by any document justifying this, upon presentation of a bank statement and his/her Ticket. Before any refund, the Ticket will be invalidated by the organiser. This request must be made within one month of the date of the visit. No refunds will be made on site. For safety reasons, the number of simultaneous visitors on the tour is limited, which is why departures are staggered, in small groups.

ARTICLE 8 – Responsibility

Safety instructions and instructions for the use of the tour devices are displayed and explained at the reception desk and at the start of the tour. The organiser reserves the right to exclude from the tour any person who does not respect the safety instructions.
The organisers accept no responsibility for any failure to comply with the safety instructions, or for any misuse of the equipment or for any use not in accordance with its purpose as stipulated in the safety instructions. Children are guided along the tour route under the responsibility of the adults accompanying them. Children and people from schools, leisure centres and other organisations are under the responsibility of their supervisors. Adults and supervisory staff must ensure that the safety instructions are followed by the people under their responsibility.
The organisers decline all responsibility in the event of loss, damage or theft of personal belongings such as clothing, cameras, glasses, keys, etc. (non-exhaustive list), which are the personal responsibility of each client.

ARTICLE 9 – Jurisdiction

The present Conditions shall be interpreted and applied according to French law. Any dispute arising from the interpretation and application of the said Conditions shall be under the exclusive jurisdiction of the Courts of Paris.
